1. Acceptance of Terms
By using ManageNEMT, you agree to these Terms of Use. If you do not agree with these terms, you may not use the application.
2. Description of Service
ManageNEMT provides a platform for company drivers to facilitate Non-Emergency Medical Transportation (NEMT) services. The application is provided to drivers by their respective transportation companies.
3. User Eligibility
To use ManageNEMT, you must:
Be at least 18 years old.
Hold a valid driver's license.
Be employed or contracted by a licensed transportation provider.
4. User Responsibilities
As a user of ManageNEMT, you agree to:
Provide accurate and up-to-date information.
Use the application solely for its intended purpose.
Comply with all applicable transportation laws and regulations.
Not misuse, alter, or attempt to gain unauthorized access to the application.
5. Data Collection and Privacy
Your use of ManageNEMT is also governed by our Privacy Policy, which details how we collect, use, and protect your data. By using the app, you consent to the data practices outlined in the Privacy Policy.
6. Termination of Access
ManageNEMT reserves the right to terminate or suspend your access if you violate these terms, misuse the application, or engage in unlawful activities.
7. Disclaimers & Limitation of Liability
ManageNEMT is provided on an "as-is" and "as-available" basis. We make no warranties regarding the accuracy, reliability, or availability of the application. By using ManageNEMT, you acknowledge and agree that:
ManageNEMT is a facilitation tool and does not provide transportation or medical services.
We are not liable for any accidents, injuries, damages, or losses that occur during transportation.
ManageNEMT does not guarantee uninterrupted or error-free service and is not responsible for system failures, data loss, or third-party service disruptions.
Users assume all risks associated with using the application, and ManageNEMT disclaims any liability to the fullest extent permitted by law. ManageNEMT and its affiliates are not liable for any damages arising from the use of the application, including but not limited to service disruptions, errors, or third-party actions.
8. Indemnification
You agree to indemnify, defend, and hold harmless ManageNEMT, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to:
Your use or misuse of the application.
Any violation of these Terms of Use.
Any dispute between you and a third party, including riders, employers, or regulatory bodies.
9. Arbitration Clause
Any disputes arising from or related to these Terms of Use shall be resolved through binding arbitration, rather than in court, in accordance with the rules of the American Arbitration Association (AAA). By using ManageNEMT, you waive your right to participate in class-action lawsuits or jury trials.
10. No Employment Relationship
ManageNEMT is a technology platform and does not establish an employment relationship between the company and its users. Drivers using the platform are independent contractors or employees of third-party transportation providers, not ManageNEMT.
11. Modifications to Terms
We may update these Terms of Use at any time. Continued use of ManageNEMT after changes constitutes acceptance of the revised terms.
12. Governing Law
These Terms of Use are governed by the laws of the United States and the state in which your transportation company operates.
